1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and The Inceptors LLC, a California limited liability company ("Company," "we," "us," or "our"), governing your access to and use of the website located at theinceptors.com and all related pages, content, and communications (collectively, the "Site").
By accessing or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to all of these Terms, you must immediately discontinue use of the Site.
We reserve the right to modify these Terms at any time. Changes take effect upon posting to this page. Your continued use of the Site after any modification constitutes acceptance of the revised Terms.

The Site is intended for use by individuals who are at least 18 years of age and are accessing the Site for professional or business purposes. By using the Site, you represent and warrant that you meet these eligibility requirements.

3. Nature of the Site — Informational Only
The Site is a professional profile and marketing website. All content — including but not limited to articles, blog posts, case studies, descriptions of past engagements, and technology commentary — is provided for general informational purposes only.
Nothing on this Site constitutes, and should not be construed as:
- Legal advice or a legal opinion

- A professional-client or fiduciary relationship of any kind
Any engagement for professional services is governed exclusively by a separate, written agreement executed between you and the Company. No information transmitted through the Site — including contact form submissions or email inquiries — creates an engagement, retainer, or any professional relationship.
4. Intellectual Property
All content on the Site — including text, graphics, logos, blog articles, case studies, code snippets, and the overall Site design — is the property of The Inceptors LLC or its content suppliers and is protected by United States copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Site content solely for your personal, non-commercial informational use. This license does not include the right to:
- Copy, reproduce, distribute, or republish any content without our prior written consent
- Modify, adapt, or create derivative works from the content
- Scrape, crawl, or use automated tools to extract data from the Site (except standard search engine indexing with robots.txt compliance)
- Use the content for commercial purposes or to train machine learning or AI models without our express written consent
- Remove or obscure any copyright, trademark, or other proprietary notices
The name "The Inceptors," associated logos, and trade dress are trademarks of The Inceptors LLC. Nothing in these Terms grants any right or license to use our trademarks.
5. User Conduct

We reserve the right to refuse service, terminate access, and pursue all available legal remedies against anyone we believe, in our sole discretion, has violated these Terms or misused the Site.
6. Content Accuracy; No Reliance
We make reasonable efforts to keep Site content current and accurate, but we make no warranty or guarantee regarding the accuracy, completeness, timeliness, or fitness for any particular purpose of any information on the Site.
Case studies and engagement descriptions reflect historical work and results achieved for specific clients under specific circumstances. Past performance does not guarantee or imply comparable results for future engagements. You should not rely on any Site content as a basis for making business, financial, technical, or other decisions without independent verification and, where appropriate, qualified professional advice.
We expressly disclaim any obligation to update content on the Site, except as required by law.
7. Third-Party Links and Services
The Site may contain links to third-party websites, platforms, or services (including LinkedIn, Google Forms, and external publications). These links are provided solely for convenience. We have no control over, and assume no responsibility or liability for, the content, privacy practices, availability, or accuracy of any third-party site.
A link to a third-party site does not constitute an endorsement, sponsorship, or recommendation by us. Your use of any third-party site is at your own risk and governed by that site's terms and privacy policies.

10. Indemnification
You agree to defend, indemnify, and hold harmless The Inceptors LLC and its members, managers, officers, employees, agents, and contractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or access to the Site
- Your violation of these Terms
- Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
- Any content you submit, post, or transmit through the Site
- Your negligence or willful misconduct
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
11. No Professional-Client Relationship
Submitting a contact form, sending an email, or engaging in any communication via the Site does not create an attorney-client, accountant-client, financial advisor-client, or any other professional-client relationship. No such relationship is formed until and unless a separate, fully executed written agreement is in place between you and The Inceptors LLC.
Unsolicited information you send to us before any such agreement is executed is not treated as confidential and may be used or disclosed without restriction, except as provided in our Privacy Policy.
12. Digital Millennium Copyright Act (DMCA)
If you believe that content on the Site infringes your copyright, please send a written notice to ashit@theinceptors.com that includes:
- Your physical or electronic signature

- Your contact information (name, address, telephone, email)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
We will respond to valid DMCA notices in accordance with applicable law.
13. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.
14. Electronic Communications
By using the Site and submitting contact information, you consent to receiving electronic communications from us (such as email responses to inquiries). You agree that all agreements, notices, and disclosures we provide electronically satisfy any requirement that such communications be in writing.
15. Governing Law
These Terms and any dispute arising from your use of the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions, and applicable federal law.
16. Dispute Resolution; Arbitration
Informal resolution first. Before initiating any formal proceeding, you agree to contact us at ashit@theinceptors.com and give us 30 days to attempt to resolve the dispute informally.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the Site — including questions of arbitrability — shall be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures (for claims under $250,000) or its Comprehensive Arbitration Rules and Procedures (for claims at or above $250,000). The arbitration shall be conducted in Santa Clara County, California, or by videoconference at our election. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver. YOU AND THE INCEPTORS LLC EACH WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING. ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY.
Exceptions. Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or breach of confidentiality obligations, without waiving the right to arbitrate other claims.
17. Venue; Jurisdiction
For any claim not subject to arbitration, or for enforcement of an arbitration award, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Santa Clara County, California, and you waive any objection to such jurisdiction or venue based on inconvenient forum or otherwise.
18. Severability
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any breach or default shall not constitute a waiver of any subsequent breach or default.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Inceptors LLC with respect to your use of the Site, and supersede all prior or contemporaneous understandings, communications, and agreements regarding the Site. These Terms do not govern any separate consulting, advisory, or services engagement, which is governed by its own written agreement.
